Welcome to the website of Grace Family Church, a non-profit religious organization located in Tampa Bay, Florida. This website is provided for informational and spiritual purposes only. By accessing and using this website and any sites or applications associated with it, you agree that you have read, understood, and agreed to be bound by these Terms of Use.

II. Acceptable Use

You agree to use this website in a respectful and lawful manner. You may not access or use the Site for any purpose other than that for which the Site is made available. The Site may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by Grace Family Church.

As a user of the Site, you agree not to:

  1. Systematically retrieve data or other content from the Site to create or compile, directly or indirectly, a collection, compilation, database, or directly without written permission.
  2. Use a buying agent or purchasing agent to make purchases on the Site.
  3. Make any unauthorized use of the Site, including collecting usernames, and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretenses.
  4. Circumvent, disable, or otherwise interfere with security related features of the Site, including features that prevent or restrict the use or copying of any Content or enforce limitations on the use of the Site and/or the Content contained therein.
  5. Trick, defraud, or mislead the organization or other users, especially in any attempt to learn sensitive account information such as user passwords, or attempt to impersonate another user.
  6. Make improper use of support services or submit false reports of abuse or misconduct.
  7. Engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots or similar data gathering and extraction tools.
  8. Use any information obtained from the Site in order to harass, abuse, or harm another person or harass, annoy, intimidate or threaten any of the employees or agents engaged in providing a portion of the Site to you.
  9. Attempt to bypass any measures of the Site designed to prevent or restrict access to the Site, or any portion of the Site.
  10. Copy or adapt the Site’s software, including but not limited to Flash, PHP, HTML, JavaScript, or other code.
  11. Upload or transmit viruses, Trojan horses, or other material including excessive use of capital letters and spamming that interferes with any party’s uninterrupted use and enjoyment of the Site or modifies, impairs, disrupts, alters, or interferes with the use, features, functions, operation, and maintenance of the Site.
  12. Post or transmit any content that is defamatory, obscene, threatening, or discriminatory.

III. User Presentations and Content

By using the Site, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information and promptly update such registration information as necessary; (3) you have the legal capacity and you agree to comply with these Terms of Use; (4) you are not a minor in the jurisdiction in which you reside; (5) you will not access the Site through automated or nonhuman means; (6) you will not use the Site for any illegal or unauthorized purpose; and (7) your use of the Site will not violate any applicable law or regulation.

Any content you contribute to this website (e.g., comments, photos) remains your property. However, you grant Grace Family Church a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, publish, and distribute such content on this website and other church materials. You represent and warrant that you have the necessary rights to grant this license. Grace Family Church reserves the right to moderate or remove any user content at its discretion.

IV. User Data and Personal Information

Any information that you provide to Grace Family Church or that is obtained through this website may be used for church purposes only. We may disclose your information to related or affiliated entities for church purposes, but we will not sell, rent or lease your personal information to commercial entities. Any information that Grace Family Church may disclose to third parties (other than related or affiliated entities) will only be released in the aggregate and will not contain any personally identifiable information. Aggregate information is useful for church statistics and marketing purposes. Grace Family Church will not otherwise disclose your name, address, e-mail address or phone number without your express consent, unless disclosure is necessary to comply with laws or relevant legal proceedings. Grace Family Church may have photographers attending events for the purpose of preserving memories. Pictures taken at events will likely be uploaded to Instagram, Facebook, X (formerly known as Twitter), and used in online and print publications with the intent to inspire and share the memories with family and friends.

The security of the information that you provide to us is very important to us. We have taken several measures to protect your information. All transactions involving sensitive information, such as your credit/debit card number and expiration date, are conducted using a SSL (Secure Socket Layer) connection. This connection provides increased security to the information as it is transmitted to our website. In the event that our security system is breached, we will attempt to notify you as soon as possible.

The organization will maintain certain data that you transmit to the Site for the purpose of managing the performance of the Site, as well as data relating to your use of the Site. Although we perform regular routing backups of data, you are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the Site. You agree that we shall have no liability to you for any loss or corruption of any such data, and you hereby waive any right of action against us arising from any such loss or corruption of such data.

V. Intellectual Property

Unless otherwise indicated, the Site is the proprietary property of Grace Family Church and all source codes, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collective, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by or licensed to the organization, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of the United States. Except as expressly provided in these Terms of Use, no part of the Site and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

Provided that you are eligible to use the Site, via a web browser or a mobile application, you are granted a limited license to access and use the Site and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use. We reserve all rights not expressly granted to you in and to the Site, the Content and the Marks.

We disclaim all warranties, including, but not limited to, warranties of merchantability and warranties of non-infringement. We do not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party through the site, any hyperlinked website, or any website or mobile application featured in any banner or other advertising, and we will not be a party to or in any way be responsible for monitory any transaction between you and any third party providers of products or services. As with the purchase of a product or service through any medium or in any environment, you should use your best judgment and exercise caution where appropriate.

VII. Limitations of Liability

In no event will the organization or its directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the site, even if we have been advised of the possibility of such damages.

VIII. User Indemnification

You agree to indemnify and hold harmless Grace Family Church, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to your misuse of this website. Notwithstanding the foregoing, we reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate, at your expense, with our defense of such claims. We will use reasonable efforts to notify you of any such claim, action, or proceeding which is subject to this indemnification upon becoming aware of it.

IX. Privacy Policy

We care about data privacy and security. By using this Site, you agree to be bound by our Privacy Policy, which is incorporated into these Terms of Use. Please be advised that the Site is hosted in the United States. If you access the Site from the European Union, Asia or any other region of the world with laws or other requirements governing personal data collection, use or disclosure that differ from applicable laws in the United States, then through your continued use of the Site, then you have expressly consented to have your data transferred to and processed in the United States. Further, we do not knowingly accept, request, or solicit information from children or knowingly market to children. Therefore, in accordance with the U.S. Children’s Online Privacy Protection Act, if we receive actual knowledge that anyone under the age of 13 has provided personal information to us without verifiable parental consent, we will delete that information from the Site.

X. Modifications

We reserve the right to change, modify, or remove the contents of the Site at any time or for any reason at our sole discretion without notice. We have no obligation to update any information on our Site, and we also reserve the right to modify or discontinue all or part of the Site without notice at any time. We cannot guarantee the Site will be available at all times. You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the Site during any downtime or discontinuance of the Site. Nothing in these Terms of Use will be construed to obligate us to maintain and support the Site or to supply any corrections, updates, or releases in connection therewith.

XI. Governing Law and Dispute Resolution

These Terms of Use shall be governed by and construed in accordance with the laws of the State of Florida. Any dispute arising out of or relating to these Terms of Use shall be resolved by [mediation/arbitration/court action] in Hillsborough County, FL.

Any and all claims or disputes arising from or related to these Terms of Use shall first be submitted to mediation in Hillsborough County, Florida, with a panel of one (1) mediator, and if not resolved by mediation, then by binding arbitration in Hillsborough County, Florida, with a panel of one (1) arbitrator under, and in accordance with, the then governing rules of The Institute for Christian Conciliation. In the event that the Institute for Christian Conciliation ceases to exist during the course of this Agreement, arbitration under this Section 7.05 shall be conducted according to the rules of the American Arbitration Association. Judgment upon an arbitration award may be entered in the District Court for the County of Hillsborough, Florida. Church and Employee shall bear their own costs related to any mediation or arbitration proceeding.

Nothing contained herein shall prevent the Church from filing any action in a court of competent jurisdiction for the limited purposes of outlining and supervising the enforcement of the mandatory arbitration process and of issuing any injunctive or similar preliminary relief as may be deemed appropriate by such court in advance of the issuance of any arbitration award.
